Terms of Service

1. Acceptance of Terms

By accessing or using GachaDrop ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. We reserve the right to modify these Terms at any time, and your continued use of the Platform constitutes acceptance of any changes.

2. Eligibility

You must be at least 18 years old to use this Platform. By using the Platform, you represent and warrant that you are of legal age and have the legal capacity to enter into these Terms. The Platform is not intended for use by individuals under the age of 18.

3. Description of Service

GachaDrop is a Web3 platform built on BNB Chain that allows users to purchase and open digital gacha packs containing Pokémon-inspired collectible cards. Each transaction is recorded on the blockchain. Users can view, manage, and sell their obtained cards through the Platform's marketplace functionality.

4. Wallet Connection and Transactions

To use the Platform, you must connect a compatible Web3 wallet. You are solely responsible for:

• Maintaining the security of your wallet and private keys
• All transactions initiated from your wallet
• Any fees associated with blockchain transactions (gas fees)
• Ensuring you have sufficient BNB to complete transactions

GachaDrop does not have access to your private keys and cannot reverse, cancel, or refund transactions once they are confirmed on the blockchain.

5. Purchases and Payments

All purchases on the Platform are made using BNB (Binance Coin). Pack prices are displayed in both BNB and USD equivalent. The USD value is for reference only and may fluctuate based on market conditions. All sales are final. Once a pack is opened and cards are revealed, no refunds or exchanges will be provided.

6. Digital Collectibles

The digital cards you receive are non-fungible tokens (NFTs) or digital items recorded on the BNB Chain blockchain. You acknowledge and agree that:

• Cards have no inherent monetary value and their value is subjective
• Card values may fluctuate based on supply, demand, and market conditions
• GachaDrop does not guarantee any future value or liquidity of cards
• Cards are purely for entertainment and collecting purposes
• You own the specific card instance but not any underlying intellectual property rights

7. Prohibited Activities

You agree not to:

• Use the Platform for any illegal purposes or in violation of any laws
• Attempt to manipulate, exploit, or abuse the Platform's systems
• Use bots, scripts, or automated tools to interact with the Platform
• Engage in any form of market manipulation or fraudulent activity
• Interfere with or disrupt the Platform's operation or servers
• Access the Platform from prohibited jurisdictions
• Create multiple accounts to circumvent restrictions

8. Risks and Disclaimers

You acknowledge and accept the following risks:

• Cryptocurrency values are highly volatile and may result in significant losses
• Blockchain transactions are irreversible and cannot be undone
• Smart contracts may contain bugs or vulnerabilities
• Regulatory frameworks for crypto and NFTs are evolving and uncertain
• The Platform may experience downtime, bugs, or technical issues
• There is no guarantee of profit or return on investment

9. Intellectual Property

The Platform, including its design, features, graphics, and content (excluding user-generated content), is owned by GachaDrop and protected by copyright, trademark, and other intellectual property laws. The Pokémon-inspired cards are fan-made derivative works not affiliated with or endorsed by The Pokémon Company.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GACHADROP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE PLATFORM.

11. Indemnification

You agree to indemnify, defend, and hold harmless GachaDrop and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any rights of another party.

12. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause or notice, for any reason including violation of these Terms. Upon termination, your right to use the Platform will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration.
